On June 20, investigators said, Presley shot at 33-year-old Anthony Green multiple times while Green was running away.
Reginald Greene, the family’s attorney, announced the family is also taking steps to file a wrongful death lawsuit against the city.
"Our goal is to figure out what happened, why it happened, hold those folks accountable and make sure it doesn't happen again,” Greene said.
Presley’s next court date is set for July 17.
