JACKSONVILLE, Fla. — Brian Fogarty, 41, quietly walked into the courtroom Wednesday and only spoke to answer questions from Judge Mark Borello.
Judge Borello: “Mr. Fogarty, can you afford an attorney?”
Fogarty: “No.”
The judge appointed him a public defender during his arraignment.
Fogarty entered a plea of not guilty to the eight counts against him, which included sexual battery, three counts of kidnapping and armed robbery.
Fogarty is accused of attacking a Jacksonville Beach realtor at a Watson Realty office on July 24. Police said he raped the realtor at knifepoint and then kidnapped her and her family and forced them to withdraw money from their bank account.
Fogarty set off a countywide manhunt, during which police released a surveillance photo of him at an ATM after police said he kidnapped another woman in the Westside, tied her up and forced her to lie down in the back seat.
The Jacksonville Sheriff's Office said after the Jacksonville Beach incident, Fogarty terrorized another woman on the Westside before his takedown by police was caught on surveillance video, which we obtained.
Action News Jax showed you how Fogarty was supposed to be under state supervision after being conditionally released from prison. Police said he cut off his ankle monitoring device on July 5.
Fogarty had been on the run for more than two weeks before police said he began a crime spree that started in Baker County.
Fogarty is facing charges in Baker County for an armed robbery at a convenience store. He’s scheduled to go before a judge again in Jacksonville on Aug. 26 for another arraignment on three additional charges involving the Westside victim.
